Agreement to Purchase

By placing a bid on any item listed on Pumper.com, you agree to be bound by the following terms and conditions:

• Final Purchase Price: You understand and agree that the final purchase price for any item you win will be the highest bid placed as shown on the auction site. The buyer is responsible for any applicable fees, licensing, transport, taxes or other charges that may occur outside of the auction.
• Payment Obligation: Upon winning an auction, you are obligated to complete the purchase at the final purchase price with the seller. Failure to do so will result in account suspension or termination.
• Account Termination: If you fail to fulfill your purchase obligation, COLE Publishing, Inc. (DBA Pumper) reserves the right to suspend or terminate your account. This may include, but is not limited to, preventing you from bidding on future auctions or using other platform features.
• Dispute Resolution: Any disputes arising from the auction process or the purchase of an item will be resolved in accordance with the dispute resolution procedures outlined herein.

Dispute Resolution for Buyers

If a buyer receives an item that does not match the seller's description or is significantly different from what was advertised, the following steps may be taken:

• Contact the Seller: The buyer should first contact the seller to discuss the issue and attempt to resolve it amicably.
• Provide Evidence: The buyer should provide clear evidence of the discrepancy, such as photos or videos.
• File a Claim: If the seller is unwilling to resolve the issue, the buyer may file a claim with COLE Publishing, Inc (COLE). COLE will investigate the claim and make a decision based on the evidence provided. If it is discovered that the seller has intentionally deceived the buyer during the auction process COLE reserves the right to suspend or terminate the seller account. COLE is in no way financially liable to either party, buyer or seller.
• Seek Legal Action: In rare cases, the buyer may need to seek legal action to resolve the dispute. This should be considered as a last resort and only pursued if other methods have failed.

To protect themselves, buyers should:

• Thoroughly Review Item Descriptions: Carefully read the item description and examine any photos or videos provided by the seller.
• Ask Questions: If you have any questions about the item, ask the seller well prior to auction close.
• Communicate Clearly: If you encounter any issues or need to cancel a bid, contact the seller immediately.
• Bid Responsibly: Only bid on items you intend to purchase.
• Use a Secure Payment Method: Pay for items using a secure payment method, such as PayPal or a credit card. This will provide additional protection in case of disputes.
• Save Evidence: Keep all relevant documentation, such as emails, messages, and photos, to support your claim.
• Complete the Purchase Promptly: Once you win an auction, complete the purchase as soon as possible.

Acceptance of Terms

COLE Publishing, Inc. (COLE) makes no representations or warranties of any kind, express or implied, as to the condition, accuracy, completeness, or suitability of any item listed for auction. All items are sold "as is, where is" without warranty of any kind by COLE, including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose. It is the sole responsibility of the buyer to inspect or inquire about any item before bidding.

All questions regarding the condition or representation of an item must be solely directed to the seller prior to the auction closing. No representations or warranties will be made after the auction closes.

By using this platform, you acknowledge that you have read, understood, and agreed to be bound by these terms and conditions. You also agree to comply with all applicable laws and regulations.

COLE Publishing, Inc. reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on the website.
